Study on Transitional Justice:
the creation of Public Defense as a balance in the System of Justice – from Prosecution to the Defendant State

The article presents how important the Public Defense is to balance the System of Justice, in opposition to prosecution. It shows the importance of the institution in democracy and for the consolidation of all human rights, which was an objective of 1988 Brazilian Constitution. However, the real implementation of the Public Defense is necessary. The analysis of the prison system is an element to discuss the controls mechanism, which includes the custody hearing and the participation of public defenders during the custody prisons.
