CARBON BORDER ADJUSTMENT MECHANISM (CBAM) AT THE EUROPEAN UNION BORDER:

Abstract

The CBAM configuration is investigated under the thematic scope aimed at solving the following question: is the CBAM an inclusive climate instrument? In order for this research to reach a solution to this question, a qualitative methodology is used, supported by scientific, documentary and official sources issued by the European Union, the World Bank and other international organizations. The use of the hypothetical-deductive scientific method is clarified, with an exploratory purpose. The reasoning is developed based on the definition of climate justice as an essential parameter, and the study is guided by the principle of common but differentiated responsibilities. Next, the CBAM Relative Exposure Index, proposed by the World Bank, is used as an unavoidable paradigm. As a result of the research, the lack of an inclusive nature of the CBAM is evident, which tends to consolidate itself as a climate instrument that deepens global climate injustice, as it can generate unequal impacts, with more severe impacts on the most vulnerable countries, which, paradoxically, bear the disproportionate burden of pollution they did not cause. Consequently, instead of being a catalyst for shared climate resilience, the CBAM manifests a European egocentric tendency, in line with its unilateral and arbitrary origin.
