The failure of prison system can be attributed to the ideology of penal management of poverty that, in the course of history, permeated the guidelines of criminal policy, making the state, instead of investing in the field of social rights, ensuring a level minimum of general living conditions, promote repressive intervention on the most disadvantaged sections of society in the economic and financial point of view. Neoliberalism and penal management of poverty are synonymous in this ideological symbolism context that makes the majority of the population believe in the capitalist coup that crime succumb or recoils at a higher degree of criminal intervention. It will examine briefly the historical trajectory of penal treatment of poverty and how is your relationship with the problems of precariousness prison and custody excess currently in Brazil.
