The article object will demonstrate that democracy has substantial elements corresponding to the constitutional provisions that provide law rules promoters of democracy. The simple adoption of majority rule, despite being a valid criterion is not sufficient, because it could be misused to the detriment of democracy itself. Thus, not all will be able to be resolved by the majority. The bibliographic research aims applied and pure results. At the end, it is argued that it is up to the courts by judicial review democratic safeguard democracy envisaged in the constitution, also is possible the changing of the material elements of democracy that should be added if it is to expand the democratic regime in favor of society in view aspect of the consecration of universal rights.
