The implementation of social security Reforms by the State, imposed by globalization and its neo-liberal project, tend to undermine the insurance system and, therefore, harming directly the working class. To ensure the permanence of the conquered rights, the Public Defense of the Union (DPU) plays a fundamental role. Based on this principle, this article sought to bring out the discussion involving the role the DPU plays to strengthen the democracy. We understand that to fulfill its institutional mission and truly contribute substantially to the construction of a real Democratic State, it is required follow the path of the radicalization of the human rights, guided by the overcome of the capitalist society, based on the exploitation of human by human, suppressive of these rights, so that it may achieve the very prior goal of its own existence: the human emancipation.
