This article aims at analyzing and discussing the role of contempt of court as an instrument
of access to justice with a way to increase the effectiveness of judicial provisions and
the feasibility of changing the amount and timing of overdue fines. It also addresses the
importance of coercive fines for civil procedural planning observing the principles of proportionality, reasonableness and the prohibition of unjust enrichment. It concludes that
the reduction or exclusion of the contempt of court should be done with caution by the
judge under the risk of putting at risk the very nature of the judicial commands.
