This study aims at reflecting on the fundamental right to health and application through the Unified Health System. In the midst of this analysis, the judgment of the Extraordinary Appeal, with general repercussion of number 566.471 / RN, in the Which the rapporteur, Minister Marco Aurelio de Melo, voted in advance. The trial is suspended due to a request for hearing. Meanwhile, the position that will be adopted by the Federal Supreme Court will be paradigmatic and of observance by the courts, reason why the subject deserves special attention.
