The development and challenges of the right to health in the European and Inter-American human rights systems

This article addresses the evolution of the right to health in the Regional Systems of Human Rights in the Americas and Europe. It contextualizes the development of the concept and of the enforceability of the right to health at an international level. Next, it analyzes the evolution of this right specifically within the scope of the Inter-American Court of Human Rights, highlighting its different phases of justiciability. Afterwards, it analyzes the progression of the protection of the right to health in the decisions of the European Court of Human Rights. In the end, it seeks to highlight the current perspectives and challenges for the full realization of the right to health, especially in view of the growing reports of its violation linked to the guarantee of a healthy and balanced environment.
