Professional rehabilitation and Decree number 3048/99:
an obstacle to the effective implemen-tation of the fundamental right to work of the insured rehabilitated by INSS

The article examines the Brazilian decree that exonerates the State from reinserting the worker rehabilitated by the INSS in the labor market and considers closed the rehabilitation process with the emission of the occupational rehabilitation certificate after completion of the qualification course offered by the social security autarchy. It analyzes from the philosophical hermeneutics, if it restricts the fundamental right to work of the insured submitted to the program of INSS professional rehabilitation and the interpretation to be bestowed to the device in the light of the foundation of human dignity, while shaft capable of uniting Brazilian constitutionalism and the law of International Human Rights.
