O procedimento de solicitação de refúgio no Brasil à luz da proteção internacional dos direitos humanos

This article aims to analyze the bureaucratic obstacles inherent in the refuge request procedure in Brazil and its (in)adequacy in relation to international guidelines for protection of human rights, increasing the situation of social vulnerability of asylum seekers. Although Brazilian’s law is progressive in terms of protection of refugees, the access to the refuge request procedure is difficult, because it’s slow and overly bureaucratic. Social realities such as the situation of unaccompanied or separated children, as well as the special condition of “mules” of drug trafficking, are excluded from access to the refugee claim. Situations like arbitrary arrests of asylum seekers and inconsistencies resulting from the lack of protection of environmental and economic refugees are also worth mentioning for the effectiveness of the protection of refugees.
